Welcome to Concrete Software!
These Terms of Service (“Terms”) govern your access to and use of Concrete Software’s mobile games, websites, and services (collectively, the “Services”). By using our Services, you agree to these Terms. If you do not agree, you must not use the Services.
1. General Information
Concrete Software, Inc. (“Concrete Software,” “we,” “us,” or “our”) provides Services to users worldwide.

2. Acceptance of Terms and Updates

Acceptance of Terms: By downloading, installing, or using our Services, you confirm that you have read, understood, and agreed to these Terms and any other referenced policies. If you do not agree, you must stop using our Services immediately.

Updates to Terms: We may update these Terms periodically. Your continued use of the Services after such updates constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.
3. Eligibility

If you are under 18, you may use the Services only under the supervision of a parent or legal guardian who agrees to these Terms.

5. Player Code of Conduct
By participating in Concrete Software’s games and community, you agree to the following Code of Conduct:
Respect Others
Treat all players with kindness, respect, and empathy. Harassment, discrimination, hate speech, or any form of abusive behavior will not be tolerated. Everyone deserves to feel safe and valued in our community.
Cheating Policy
We do not condone cheating, using hacks within our games, or exploiting bugs. If you are found to be cheating, we may terminate your account or limit your access to certain in-game features, depending on the scope of the behavior, with or without prior notice.
Respect Privacy
Respect the privacy and boundaries of other players. Avoid sharing personal information without consent and refrain from invading others’ privacy, both in-game and in external interactions.
Impersonation
Do not impersonate other players, community members, or Concrete Software employees. Misleading others by falsely presenting yourself as someone else or as a representative of the company is prohibited. Such behavior will result in penalties, including potential suspension or termination of your account.
Improperly Obtained Content
Users found to have inventories containing content acquired outside of normal gameplay are subject to penalties. No penalties will be issued for content legitimately obtained via gifting, customer service intervention, social means, and/or promotional events.

First Offense: Users may be temporarily suspended from using the inventory system, and a full inventory reset may be applied.

Repeat or Extreme Offenses: Users may be permanently suspended from using the inventory system, and a full inventory reset may be issued.
Review Game Rules and Policies
Familiarize yourself with these rules, our Terms of Service, Privacy Policy, and community guidelines, and adhere to them at all times. These rules are in place to ensure a fair and enjoyable experience for everyone.
Reporting Violations
If you encounter behavior that violates this Code of Conduct, please report it through appropriate channels, such as in-game reporting systems or community moderators. Your reports help us maintain a positive and welcoming environment for all players.
Ban Policy
We reserve the right to refuse service, restrict access, or implement bans for any behavior that violates this Code of Conduct, subject to the terms outlined in our Terms of Service and applicable policies.
6. In-App Purchases
All in app purchases made through app stores (e.g., Google Play, Apple App Store, Xsolla) are subject to those stores’ terms and conditions.
7. Employee Participation in Games
Employee Participation Disclosure
Concrete Software employees, contractors, and affiliates (hereafter “Employees”) may participate in the games and tournaments provided by Concrete Software. Such participation is intended to enhance quality assurance, improve gameplay mechanics, and foster community engagement.
Fair Play and Regulated Accounts
To ensure competitive fairness:

Employees participating in tournaments or games do so under regulated accounts that are subject to the same rules, restrictions, and gameplay mechanics as all other players.

Employees are strictly prohibited from utilizing insider knowledge, tools, or resources unavailable to the general player base to gain an advantage.
Eligibility for Prizes
Employees are not eligible to receive monetary or physical prizes from tournaments or events.
Violation Review and Penalties: Any reported violations of these Terms by Employees will be reviewed and, if substantiated, will be subject to the same penalties applied to any other user, including account suspension or termination.

9. User-Generated Content (UGC)

By submitting content to the Services, you grant us a worldwide, royalty-free, perpetual license to use, modify, reproduce, and distribute your content.

You represent that your UGC does not infringe on third-party rights or violate any laws.

We reserve the right to remove UGC that violates these Terms or our policies.
10. Service Availability
We do not guarantee uninterrupted availability of the Services. Services may be temporarily unavailable due to technical issues, maintenance, or other reasons beyond our control.
11. Binding Arbitration and Class Action Waiver

Arbitration Agreement: All disputes related to these Terms or the Services will be resolved through individual, binding arbitration under the Federal Arbitration Act (FAA). Arbitration will be administered by the American Arbitration Association (AAA).

Class Action Waiver: You agree to bring disputes solely on an individual basis, waiving any right to class or collective actions.

Opt-Out Option: You may opt out of arbitration by notifying us in writing at support@concretesoftware.com within 30 days of first agreeing to these Terms.
12. Intellectual Property
All content, including game mechanics, characters, artwork, logos, and code, is owned by or licensed to Concrete Software and is protected under applicable intellectual property laws.

License Grant: You are granted a personal, non-exclusive, and non-transferable license to use the Services for personal, non-commercial purposes.

Restrictions: You may not modify, distribute, reverse-engineer, or use any part of the Services for commercial purposes without our consent.
13. Monitoring and Privacy
Concrete Software reserves the right to monitor gameplay and communications to ensure compliance with these Terms. By using the Services, you consent to such monitoring.

15. Warranty Disclaimer and Limitation of Liability

Disclaimer: The Services are provided “as is” without warranties of any kind.

Limitation of Liability: Concrete Software’s liability is limited to the amount you paid for the Services in the 12 months prior to the claim.
15. Termination of Services

We may suspend or terminate your account for violations of these Terms or at our sole discretion.

Upon termination, you lose access to your account, Virtual Items, and associated data without refund or compensation.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Minnesota. Disputes not subject to arbitration will be resolved exclusively in Minnesota courts.
